What is eDiscovery and Why is it Important?
The Electronic in Discovery
In both the Civil and Criminal Legal process there is a period of Discovery. During this time a formal process is in place to facilitate the disclosure of witnesses and evidence that the parties will present at trial. Due to the introduction of electronic information into our everyday lives, electronically stored information (ESI) has become the main type of evidence we now see in legal matters. Due to issues surrounding the variety in the type of ESI created as well as the sheer amount of ESI created, the field of eDiscovery was born to address those challenges and ensure efficiency as well as ethical practices in the discovery process.
